A man suffered frostbite when sent on a long, cross penine journey by his boss in a van with no heater in winter. The van was old and had only a metal seat. The man suffered frostbite as a result. The defence was that frostbite was too remote as not being foreseeable.
The court agreed but said that as cold related damage was foreseeable it was irrelevant which type. Case won.
